It is feasible for both the lawful landowner and the tenant who holds customary rights to the land (referred to as “kibanja owner”) to come to an agreement that allows them to coexist and utilize the same land without violating any legal regulations or putting themselves in a compromising situation.
"Addressing Land Ownership Disputes within Uganda's Mailo Land Tenure System"
Introduction:
In Uganda, land is a precious asset with its development and value intricately tied to its occupants, particularly under the Mailo land tenure system. This system involves two primary categories of occupants: the Registered Landowners and the Bibanja Owners who hold occupancy rights. While legal safeguards exist to protect the interests of both parties, conflicts often arise, ranging from illegal evictions to boundary disputes. Solvent Asset Management, experienced in land asset management, emphasizes the importance of proper land documentation to minimize these conflicts.
Understanding Mailo Land Tenure and Conflict of Interests:
Mailo land tenure encompasses two key occupants – Registered Landowners and Bibanja Owners. The constitution of Uganda safeguards the rights of both parties, ensuring the Bibanja Owners can quietly possess their land and be evicted only through a court order. Additionally, they enjoy hereditary security of tenure, granting them equal standing with the Mailo landlords. However, despite these legal protections, disputes like unlawful evictions, boundary conflicts, and inheritance battles remain common.
The Role of Proper Documentation:
Solvent Asset Management asserts that registering land ownership is not only vital for national data but also for individual landowners. Proper documentation, especially of Kibanja (land) ownership, should be prioritized to mitigate these conflicts. By clearly defining ownership, boundaries, and rights, land registration fosters a positive relationship between Mailo landlords and Bibanja Owners. This transparency paves the way for more equitable negotiations and resolutions.
Nurturing Equitable Agreements:
When Registered Landowners have comprehensive information about Bibanja Owners and their plot sizes, it opens the door to negotiations that benefit both parties. In some cases, landowners might consider relinquishing certain rights in exchange for a percentage of monetary compensation or even land. This approach promotes collaboration and reduces the adversarial nature of disputes, promoting a harmonious coexistence.
Conclusion:
Uganda’s Mailo land tenure system encapsulates the complexities of land ownership, with Registered Landowners and Bibanja Owners often entangled in conflicts that can be resolved through proper documentation and transparent negotiations. Solvent Asset Management’s expertise underscores the importance of registering land ownership to establish a solid foundation for resolving disputes, fostering understanding, and ultimately ensuring a more peaceful and productive land management system for all parties involved
"Strategies for Attaining a Shared Understanding"
Determining the fee a kibanja owner can offer to the landlord in exchange for acquiring the rights and the chance to become a registered owner varies between 30% and 40% of the land’s monetary value.
Alternatively, a kibanja owner may choose to transfer a portion of their kibanja to the landlord in return for obtaining the rights and the opportunity to become a registered owner. This also falls within the range of 30% to 40% of the kibanja’s size.
In some instances, a landlord can opt to compensate the kibanja owner with a monetary value equivalent to their parcel. In such cases, the kibanja owner would be relocated.
